Bayer to appeal $2 billion verdict in Roundup cancer lawsuit

The trials were the first of an estimated 13,000 lawsuits against Monsanto

The Pilliods, who are in their mid-70s, had been longtime users of Roundup by the time Alva Pilliod was diagnosed with non-Hodgkin's lymphoma in 2011. Alba Pilliod remembers the heartbreak getting the news. A California jury has awarded $2.055 billion to Alva and Alberta Pilliod of Livermore, California.

The Pilliods said they had used the Roundup herbicide on their yard and other properties for decades. "We hope to get justice", Mrs Pilliod said past year according to the lawyers website. "Most NHL has no known cause, and there is not reliable scientific evidence to conclude that glyphosate-based herbicides were the "but for" cause of their illnesses as the jury was required to find in the case". It was caused by Roundup.

"The verdict in this trial has no impact on future cases and trials, as each one has its own factual and legal circumstances", Bayer said.

The jury set the total punitive damages at $2 billion and added $55 million in compensatory pay, concluding that Roundup - based on herbicide glyphosate - had been defectively designed, and that the company failed to warn of the herbicide's alleged cancer risk.

"They should let consumers make the choice about whether or not they want to use the product". People who are not farm workers or groundskeepers are being exposed to the cancer-causing chemical. "That needs to be on the Roundup label", said Wisner. Bayer is appealing each of these verdicts.

The jurors agreed that Alva and Alberta Pilliod's exposure to Roundup used for residential landscaping was a "substantial factor" in their non-Hodgkin's lymphoma.

Earlier this month, the EPA said that glyphosate is not carcinogenic. Bayer's statement on Monday said the plaintiffs "relied heavily" on the agency's 2015 assessment but called it "an outlier among global health regulators and scientific bodies".

The case marks the third verdict delivered against Roundup since August 2018. The previous ones were in federal court and state court in San Francisco.

In March, a federal jury in San Francisco awarded $80 million to another California man after finding Roundup caused his cancer. That was later reduced to $78 million.

"The verdicts are making it a little more likely that Monsanto will agree to some sort of settlement system", said Levine.

"Bayer is disappointed with the jury's decision and will appeal the verdict in this case", it said in a statement after Monday's verdict.

"There is zero chance it will stand", said University of California, Hastings School of Law professor David Levine. The German agro-chemicals and drugs giant finalised its massive acquisition of Monsanto past year, but the blockbuster purchase has turned out to be plagued with other massive costs.

Bayer's management was already in hot water over the wisdom of the Monsanto takeover, with shareholders having effectively told CEO Werner Baumann in a no-confidence vote last month that his job is in jeopardy. The verdict was announced after the trading session closed, AP points out.

Bayer's day began on Tuesday with a share-price drop to €53.66 ($60.29)-a level it has not seen since June 2012, and which represents an nearly 46% fall in value since the closure of the Bayer-Monsanto merger in June past year.
