"The court's decision casts doubt on the sincerity of two key promises made by the Trudeau government, conciliating environmental issues with the economy and reconciliation with First Nations".

The ruling came within hours of Kinder Morgan Canada Ltd. shareholders voting more than 99 per cent in favour of the sale of the Trans Mountain pipeline and its expansion project to the federal government for $4.5 billion.

Regulatory lawyer Bill Gallagher, the author of "Resource Rulers" and the upcoming book "Resource Reckoning", said today's ruling was a "benchmark" in the rise of what he called "Native empowerment" over natural resources in Canada.

The B.C. government acted as an intervener in the case and also filed a separate reference case to the B.C. Court of Appeal to determine if it has the right to restrict bitumen shipments from Alberta.

"We tell the prime minister to start listening and put an end to this type of relationship".

That call was echoed by the Union of BC Indian Chiefs (UBCIC). "This one will most doubtless be a stable, industrial mission as soon as we de-risk it".

"Missing was a genuine and sustained effort to pursue meaningful, two-way dialogue". The case is a combination of almost two dozen cases against the crude oil pipeline, according to the Globe and Mail.

The court found that the National Energy Board's environmental assessment of the project was fatally flawed because it ignored the potential impact of increased tanker traffic off British Columbia's coast. The unjustified exclusion of marine shipping from the scope of the Project led to successive, unacceptable deficiencies in the Board's report and recommendations.

He did not rule out appealing the court ruling. "Trans Mountain has been in consultations with this project for well over five years but just from the outside looking in, I don't see how any reasonable person could say that Trans Mountain hasn't done their due diligence with respect to consultation and educating all affected people of what the impact of this project is going to be".

Quintal said Indigenous ownership can play a key role in environmental stewardship.

The situation is quite different for pipeline projects that cross vast geographies, said Gratton.

The federal government bought the existing Trans Mountain pipeline for four and a half billion dollars and now has to rework part of its consultations with First Nations groups.

The court's judgment could be appealed a final time to the Supreme Court of Canada.

In May the government of Justin Trudeau agreed to buy the pipeline from Kinder Morgan Canada Limited for nearly $US3.5 billion ($NZ5.2b), betting it would win the court battle and expand Trans Mountain despite fierce political and environmental opposition.

Several Indigenous groups and environmentalists applauded the ruling, which emerged from a legal challenge backed by more than a dozen groups, including the city of Vancouver, several First Nations and environmental organisations.
