Trump can pardon himself, says Giuliani

Trump's team has attempted to discredit the investigation led by Robert Mueller and soften the impact of the special

President Trump's lawyer Rudy Giuliani claimed Sunday that Trump has the power to pardon himself.

"It's absolutely necessary for a functioning government and democracy that we maintain a system where no one person is immune from the consequences of their actions", she said.

"He has no intention of pardoning himself", said Giuliani, noting it's a "really interesting constitutional argument: 'Can the president pardon himself?'"

"I don't recommend that this president or any subsequent president avail him or herself of this power".

White House spokeswoman Sarah Huckabee Sanders told reporters on Monday that the White House hasn't asked for an updated or new legal opinion on the matter. "Trump has talked about it", the Senate minority leader said.

"I think the political ramifications of that would be tough", Giuliani added. "I don't recommend it", Lee concluded.

Mr Trump's lawyer Rudy Giuliani said the president can not be indicted or subpoenaed and has the power to pardon himself, leaving impeachment by the US Congress likely the remedy for presidential misconduct.

Trump's lawyers don't want him to be interviewed by Mueller, accusing the independent prosecutor, himself a former Federal Bureau of Investigation chief, of trying to "trap" the president in a lie. They have to make a decision without him.

Trump's attorney Rudy Guiliani claimed on Sunday that the President could have shot former FBI director James Comey to end his Russian Federation investigation and not faced prosecution while in office.

Mr Mueller is investigating whether Russian Federation meddled in the presidential election and whether Mr Trump's campaign colluded with Moscow.

Bharara, who was appointed by former president Barack Obama, told CNN that for a president to pardon himself would be "outrageous". After explaining the situation to his viewers, He is entertained by another excuse being given by Trump's team, saying to be interviewed by Mueller would demean the office of the president around the world.

The US president's remarks came in tweets in which he said his right to pardon had been "stated by numerous legal scholars". Trump said Monday on Twitter.

"The text of the Constitution is not clear on the issue", says Hamline University law professor David Schultz. "Certainly no one is above the law", Sanders said when asked if Trump believes he is above USA law.

"It seems unlikely in my mind that you could pardon yourself", said Republican Sen.

"He could, if he wished, terminate the inquiry, or even exercise his power to pardon if he so desired", the lawyers added.

In 1998, US President Bill Clinton was charged with obstruction as part of his impeachment trial.

Mr. Trump's legal team has long pushed the special counsel to narrow the scope of its interview. "I agree this raises questions about impartiality, but then again, in America, nobody sees prosecutors as being independent and impartial... they're out to win".
