O'Reilly Accuser Sues Because Bill Keeps Talking About Her

A woman who settled with Bill O'Reilly is suing the former Fox News star and the cable network that used to employ him for defamation and breach of contract.

According to the complaint, Bernstein repeatedly complained to Fox's HR department as well as executives at the company about O'Reilly's "mistreatment" and that "both defendant Fox News ... and O'Reilly knew that before making the statements above".

In the New York Times story, O'Reilly said he paid Bernstein and other women who complained because he's "vulnerable to lawsuits from individuals who want me to pay them to avoid negative publicity".

O'Reilly's representatives had no immediate comment on the lawsuit, filed Monday in federal court in Manhattan.

O'Reilly was forced out of Fox News in April following a series of revelations about alleged sexual harassment and abuse.

"O'Reilly depicted Ms. Bernstein in a false light, criticized and derided her character, raising doubt about her intentions in detailing O'Reilly's manhandle to HR and at last being constrained out at Fox News with a settlement assention", she asserts in her suit. "They should release all victims from their NDAs and let the truth out".

Rachel Bernstein, who was a junior producer at FOX News, claims she settled a lawsuit in 2002 for an undisclosed amount.

One of Bernstein's lawyers said, quote, "It is cowardly to publicly attack these women knowing they have been subjected to contractual provisions requiring absolute silence". According to the Times, Bernstein's suit did not, unlike some of the other claims against O'Reilly, involve sexual harassment.

"O'Reilly portrayed himself as a "target" and claimed that complaints against him are extortionate", Ms. Bernstein's lawsuit said. In the Times's April report, the news network claimed that they maintained an employee hotline and that no one had used the hotline to report O'Reilly (O'Reilly has repeated this claim as well). The story said Bernstein left Fox "with a payout and bound by a confidentiality agreement", and that her settlement "was far less" than the others. She accused him of forcing her into a "nonconsensual relationship".
